Dear Secretary Clark:

I hereby place my name into nomination for the Advisory Committee on Online Access and Security. I commit to attending the meetings of the Advisory Committee on February 4, February 25, March 31, and April 28 of the year 2000.

I was General Counsel to the U.S. Privacy Protection Study Commission and have coordinated many industry self-regulatory efforts. I represent several segments of American information and Internet industries. This includes the Individual Reference Services Group, the Electronic Commerce and Consumer Protection Group. I also represent Commercial Internet eXchange ("CIX"), an association of 150 Internet service
providers.

If accepted, I will represent the interests of the IRSG and CIX on the Advisory Committee.

I have studied the issues of access to records in an online and traditional context. I also have spent a significant amount of time on security and encryption issues. I understand the competing interest and believe that I have the experience to advise the FTC on theses issues.

In addition to being an expert on privacy, I am an expert on Freedom of
Information Act ("FOIA") and access to records. I have litigated many FOIA cases including Vaughn v. Rosen.
